Please take notice that the Hannaford Bros. Co. Notice of Community Development Grant Fund Availability – Call for Applications
Please be advised the Town of Bridgton is soliciting applications for the Town of Bridgton Maine & Cumberland County Community Development Block Grant CDBG Program for FFY 2018. Applications are due January 22, 2018, on or before 4 p.m. Applications are for Public Service. Applications must be for programs serving those with low/moderate income or for the elimination of slum and blight. Applications will be reviewed by staff and forwarded to the Community Development Committee for a recommendation and then forwarded to the Select Board for approval. It is not known, as of this writing, the amount of funds the town will receive.
Applications are available in the Municipal Office at 3 Chase Street, Bridgton, Maine 04009, or on the town’s website: www.bridgtonmaine.org. Applicants are required to attend one MANDATORY “workshop” with Community Development staff to review requirements and project eligibility. There will be two opportunities to attend a workshop: Tuesday, December 12, 2017 at 10 a.m. OR Thursday, December 14, 2017, at 10 a.m.

Notice to person(s) plowing driveways within the limits of the Town of Bridgton, Maine
Warning is hereby given that no person or persons shall plow, shovel or otherwise deposit snow, or cause the same to be done, into the limits of any traveled public way within the Town of Bridgton.
It is permissible to plow the snow bank left by the street plow directly in front of a driveway to each side of the driveway onto the snow bank.
Pursuant to MRSA 17A, Section 505, “placing Obstructions on a Traveled Road” and MRSA 29A Section 2396 “Snow, a person may not place and allow to remain on a public way snow or slush that has not accumulated there naturally.” Persons in violation of these laws shall be subject to legal action.

Highland Lake Lowering Notification
Starting on October 1, 2017, Highland Lake’s water level will be lowered temporarily so lakefront property owners can perform dock repairs, place riprap, clean the exposed lake bottom along the shoreline, and perform other waterfront improvements.
Lakefront property owners should take actions necessary to protect their personal property. This includes, but is not limited to, adjusting pontoon retaining lines and properly securing or removing boats, canoes and kayaks.

The Town of Denmark is seeking bids for two road resurfacing projects.

1. Berry Road – Shim and Overlay – starting just at the intersection of Berry Road and East Main Street (Route 117) to the Cross Road intersection. (4,570’ X 21’). Estimate 485 tons shim and 595 tons of surface mix.

2. Hio Ridge Road – Reclaim – starting at the intersection with East Main Street, (Route 117) to Mountain Road. (5,590’ X 21’6”). Estimate 13,355 square yards. Reclaim bid to be based on price per square yard. Pavement: 2.5” base coat (5,590’ X 21’). Estimate 1,800 tons

Sweeping, tack and butt joints, flagging and signing to be included in the pricing. Bid is to be per ton laid for pavement.

The Town of Denmark is seeking proposals for the construction of a compactor station for the single-source recycling of items within the Town of Denmark.

The Town is seeking to have a recycling compactor station constructed at the Denmark Transfer Station located at 37 Hancock Pond Road, Denmark, Maine 04022. Specifications for the project are available from the Denmark Town Office, or on the Town of Denmark’s website, www.denmarkmaine.org

Interested contractors must attend a site visit on July 11, 2017, at 11:00 a.m., at the Denmark Transfer Station.

The proposals must be received by the Denmark Town Office no later than 4:30 p.m., July 25, 2017. Proposals shall be in a sealed envelope marked: “Recycling Compactor Station Proposals.”

AND CBJ PROPERTIES, INC., FOR THE RIGHT TO EXCAVATE AND PROCESS LOAM, COMMON BORROW, GRAVEL AND ROCK AT THE HEATH QUARRY PROPERTY, CASCO, MAINE.

CONDITIONS OF SAID CONTRACT ZONE are to extend the Contract Zoning Agreement for a ten-year period and to delineate the property owned by CBJ Properties, Inc., and leased by P&K Sand and Gravel, Inc.

The form of said Contract Zone Agreement and its Exhibits are attached hereto.

The Amendment to and Extension of Contract Zoning Agreement is made this _________________day of _______________, by and among the Town of Casco, a municipal corporation, located in Cumberland County, State of Maine (hereinafter “Casco”), P&K Sand & Gravel, Inc., a Maine corporation located in Naples, Maine (hereinafter “P & K ”), and CBJ Properties, Inc., a Maine corporation located in Naples, Maine (hereinafter “CBJ”).

WITNESSETH

WHEREAS, the Parties entered into a Contract Zoning Agreement on November 20, 1997, (hereinafter the “Agreement”), which Agreement provided for the excavation and processing of loam, common borrow, gravel and rock on property owned by CBJ Properties, Inc.; and

WHEREAS, the Agreement provided for the operation of the Property for an initial period of twenty years and provided for ten-year extensions, provided that there were no significant changes to P&K’s operations on the Property and P&K’s operations on the Property continue to comply with all State and local laws, statutes, rules, regulations, codes, ordinances and orders; and

WHEREAS, the Parties entered into an Amendment to the Agreement, dated June 19, 1999, which amended the area made subject to the original Agreement (hereinafter the “Property”), and affirming all of the other existing provisions of the Agreement; and

WHEREAS, the Parties now seek to extend the Agreement, as amended on June 19, 1999, for an initial 10-year period, subject to the terms of the original Agreement and certain amendments set forth herein; and

WHEREAS, the Planning Board of the Town of Casco, pursuant to 30-A M.R.S.A. Section 4352(8), and after notice and hearing and due deliberation thereon, recommended the Extension and Amendment of the Agreement; and

WHEREAS, the Town of Casco, by and through its Town Meeting held on _________________, 2017, has determined that said Extension and Amendment of the Agreement will be pursuant to and consistent with the Town’s Comprehensive Plan and has authorized the execution of this Extended and Amended Agreement;

NOW, THEREFORE, in consideration of the mutual promises made by each party to the other, the parties covenant and agree as follows:

1. P&K shall be authorized to continue to operate the Property under the terms of the Agreement, as amended herein, for an additional ten-year period, with said period to commence upon the date of execution of this Extended and Amended Agreement, but in no event later than _______________.

2. A Plan of the Property subject to this Extended and Amended Agreement is attached as Exhibit A hereto.

3. Section 2 of the Agreement, Special Matters, is hereby amended to read as follows:

(a)Minimum setbacks for excavation and/or disturbed areas. Twenty-five (25) feet from any abutter’s property line, 25 feet from any wetlands, 130 feet from any wetland of special significance, 130 feet from any town designated stream, and 250 feet from any lake.

(b)For the purposes of this agreement, a “wetland” shall be as defined in the 1987 U. S. Army Corps of Engineers Wetland Delineation Manual.

(c)For the purposes of this Extended and Amended Agreement, “abutter’s property line” shall be any boundary line between land owned by CBJ Properties, Inc., and leased by P&K and land owned by other people or entities.

(d)For the purposes of this Extended and Amend-ment Agreement, a “wetland of special significance” shall be as defined in the Town of Casco Zoning Ordinance (revised June 10, 2015).

(e)The Casco Code Enforcement Officer (hereinafter the “CEO”) shall approve each proposed individual area of excavation on the Property upon finding all of the following conditions are met and maintained:

1.Each individual area of excavation consists of less than 2 acres of total excavated area;

2.There is a minimum of 100 feet undisturbed distance between the edge of the individual area of excavation and any abutter’s property line;

3.There is a minimum of 25 feet undisturbed distance between the edge of any individual area of excavation and the upland edge of any wetland;

4.The total area of individual areas of excavation open in each year shall not exceed 6 acres; and

5.There shall be a minimum 100-foot undisturbed separation between individual areas of excavation.

The CEO shall have the authority to require Casco Planning Board Site Plan Review approval of any individual area of excavation.

(f)  The CEO shall approve the location of small movable screens for loam and gravel processing at sites other than the central processing site upon finding that all of the following conditions are met and maintained:

1.There is a minimum of 100 feet of undisturbed area between the proposed screen site and any abutter’s property line; and

2.There is a minimum of 25 feet between proposed screen site and any wetland.

The CEO shall have the authority to require Casco Planning Board Site Plan Review approval of any area of excavation.

(g)  Each of the following activities shall require Planning Board review and approval:

1.Central mineral processing sites which shall include the following activities: screening, crushing, and stockpiling.

2.Excavation of any individual area of excavation where the total excavated area of that site exceeds 2 acres.

3.Excavation of any individual area of excavation within 100 feet of any abutter’s property line.

4.Excavation of any individual area of excavation within 25 feet of any wetland.

(h) That prior to opening any new area for mineral extraction purposes a wetland report and mapping shall be completed for all surrounding land within 150 feet of the area subject to disturbance as part of the mineral extraction use. All wetlands must be evaluated by a wetland specialist with accredited certification in the field of identifying wetland functions and soil limits.

4. Annual Report.  P&K shall provide to the CEO an annual report setting forth the estimated area and volume of materials processed or removed from the site. This report shall be accompanied by sketch plans with sufficient detail to allow the CEO to determine where work has occurred during the prior year. These reports shall be submitted no later than December 31 of each year.

5. Enforcement. Any violation of the terms of the Agreement, as extended and amended, shall be subject to enforcement under the provisions of 30-A M.R.S.A. Section 4452.

6. Continuation of Other Terms. Except as expressly extended and amended herein, the terms of the original Agreement, as amended by the June 19, 1999 Amendment, shall remain in full force and effect.

This Agreement is made this ____ day of _____, 2017, by and between the Town of Casco, a municipal corporation, located in Cumberland County, State of Maine (hereinafter “Casco”) and Brian E. Chamberlain and Beverly J. Chamberlain, both of Casco, in the County of Cumberland, State of Maine (hereinafter “Chamberlain”) and is as follows:

W I T N E S S E T H

WHEREAS, the Town of Casco on June 17, 1993 entered into a Contract Zoning Agreement regarding then unimproved property at Cooks Mills Road, also known as West Fountain Hill Road, Casco, Maine (“the Property”) being depicted on Town of Casco Tax Maps on Tax Map 8, Lot 14A, consisting of approximately 11.98 acres more or less, together with a certain easement to abutting property, which easement area includes approximately 1/3 acre and is set forth as a reservation in the conveyance of Alan W. Renfrew to Dennis T. Strout and Denise A. Strout dated September 5, 1991, and recorded in the Cumberland County Registry of Deeds at Book 9705, Page 27, and which property has been previously depicted on a plan entitled “Settlers Village,” a standard boundary survey for Alan Renfrew by John A. Belding dated February, 1993, recorded in the Cumberland County Registry of Deeds in Book 193, Page 226, and revised December 20, 1993, and is also depicted on a “Plan of Proposed Division of Settlers Village” completed by Lost Corner Land Surveying, LLC, dated May 20, 2016; and

WHEREAS said premises together with the appurtenant easement has been conveyed by the Estate of the said Alan W. Renfrew to Brian Chamberlain (a/k/a Brian E. Chamberlain) and Beverly J. Chamberlain by Deed of Sale by Personal Representative dated November 29, 2007, and recorded in the Cumberland County Registry of Deeds in Book 25667, Page 241, which conveyance is made subject to the aforementioned contract zoning agreement; and

WHEREAS the Contract Zoning Agreement executed by the said Alan W. Renfrew and the Town of Casco provided, in substantial part, that the development of the property was to consist of certain common and individual structures designed to resemble “A small clustered colonial New England Community” to be owned, maintained, and operated as a single unified rental operation, to be laid out in such a manner as to preserve the natural vegetation and rural character of the area wherever possible; and

WHEREAS the development of the property was in such a manner which substantially, but not completely fulfilled by the terms and conditions outlined in the aforesaid contract zoning agreement, with some structures not completed and others completed in a style and of materials differing from said Contract Zoning Agreement; and

WHEREAS the time for completion of the development as contemplated in the original Contract Zoning Agreement has now passed and it has become apparent that it is neither practical nor economically viable to complete the development as originally contemplated; and

WHEREAS both Casco and Chamberlain are desirous of establishing an amended contract zoning agreement to recognize the substantial completion and conformity with the original Contract Zoning Agreement; to recognize the substantial conformance with the Town of Casco Zoning Ordinance as it pertains to a Planned Residential Development; and to fix and establish the relevant rules and regulations under which the development shall be completed and maintained; and

WHEREAS Casco has, pursuant to the provisions of 30–A M.R.S.A. § 4352(8), adopted provisions of the Zoning Ordinance that allow the adoption and implementation of a contract zoning agreement or an amendment such as that contemplated herein and that a zoning amendment is required to accommodate the existing plan and proposed design of the continued residential use of the premises; and

WHEREAS, the proposed Amended and Restated Contract Zoning Agreement has been determined to be consistent with the Town’s Comprehensive Plan by fostering the core values and goals of the plan in providing for a sense of community and planned residential development; (Town of Casco, Maine Comprehensive Plan – Pages 11 & 12) The dedication and preservation of open space;  the conservation of air and water resources quality through open space, reasonable lot density, required vegetative buffers and the protection of the rural character of the Town of Casco.  The revised development of Settlers Village will not increase the need for essential municipal services such as police, fire, education, waste disposal, and the like, and recognizes the spirit of the Town’s residential land use plan. (See also Maine Comprehensive Plan, land use, rural residential future use plan.)

WHEREAS the Planning Board of the Town of Casco pursuant to 30–A M.R.S.A. § 4352(8), and after notice and hearing and due deliberation thereon, recommended the Amended and Restated Contract Zoning Agreement, aforesaid, subject to certain conditions set forth herein; and

WHEREAS, Casco, by and through the vote of the inhabitants thereof, at a Town Meeting duly held and convened on ________________, 2017, having determined that the Amended and Restated Contract Zoning Agreement will be pursuant to and consistent with the Town’s Comprehensive Plan and will comply with the requirements of 30-A M.R.S.A. § 4352(8) and has therefore authorized the execution of this contract.

NOW THEREFORE, and in consideration of the mutual covenants herein made by each party to the other, the parties covenant and agree as follows:

1. The Property Rezoned.

Upon the effective date hereof, the Zoning Map for the Town of Casco, as recognized by the Casco Zoning Ordinance (“The Ordinance”), as amended, and on file in the office of the Town Clerk and incorporated by reference into the Ordinance by Section 4.2 thereof, is amended to provide for the amended contract zone set forth herein and depicted on a plan of proposed division of Settlers Village, West Fountain Hill Road, Casco, Maine, attached hereto as Exhibit A, which zone shall be referred to as the “Settlers Village Contract Zone.”

2.  Space, Bulk, and Density Requirements and Performance Standards for the Settlers Village  Contract Zone.

(a) The Settlers Village Contract Zone shall consist of no more than 8 principal structures, all of which are now in existence. Each principal structure shall be located on a separate lot, the dimensions of which are shown on Exhibit A. No changes shall be made to these dimensions once the contract rezoning has been approved, unless such changes meet the following requirements:

All lots shall contain a minimum of 50,000 square feet, with the exception of lots 7 and 8. No buildings shall be constructed within 20 feet of all interior roadways. No buildings shall be constructed within 25 feet of any sidelines. In addition, there shall be maintained a 50-foot vegetative buffer along the West Fountain Hill Road and a 25-foot vegetative buffer along the remaining perimeter of the Settlers Village area, as depicted on said plan. Buildings may not exceed 35 feet in height. No ancillary structure shall have a greater footprint than 24’ x 24’. Materials used shall conform with the character of the neighborhood.

In no event shall any lot approved hereby be reconfigured without an amendment to this Amended and Restated Contract Zoning Agreement.

(b) A common area has been created and is identified as shown on Exhibit A. Access to said common area shall be clearly and accurately defined with signage, pathways, and other means determined to be necessary. Access shall be by foot only.  All residents of the Settlers Village Contract Zone shall have access to and use of the common area, in accordance with rules and regulations established by the Homeowners Association.

(c) The interior roadways shall be private. The minimum travel way width shall be 18 feet with gravel surface with no less than 18 inches depth of gravel, and six-foot shoulders. Riprap for drainage and/or culverts as necessary shall be provided. All maintenance, upkeep and repair shall be the responsibility of a homeowners association that will take ownership of the interior roadways and common open space after the sale of more than three lots hereby created. The homeowners association shall be formed prior to the sale of any lots and membership in the homeowners association will be required by a declaration of covenants that will be incorporated into the deed for each lot. The homeowners association shall have the authority to make assessments for maintenance of the roadways and any other commonly-owned facilities. Prior to the sale of three lots, Chamberlain shall be responsible for the maintenance of the interior roadways and any other commonly owned property.

(d) The parties recognize that soil testing, septic designs, and septic installation have previously been approved by the Town of Casco and shall continue as the same now exist. Any changes to the septic design must be done in accordance with applicable State regulation and must receive the prior approval of the Code Enforcement Officer.

(e) Vegetative buffers shall be maintained as defined on Exhibit A.

(f) All additions or modifications of structures appurtenant to the existing structures shall comply with applicable Town of Casco building codes and applicable ordinances and shall comply with the provisions of this Amended and Restated Contract Zoning Agreement.

(g) All such additions or modifications of existing structures and all appurtenant structures shall be of such style and of such building materials as shall be in conformity with those of existing structures.

3.   Binding Effect; Enforcement

The above-stated restrictions, provisions and conditions are an essential part of the rezoning. They shall run with the subject premises, shall bind the owner and their successors, heirs and assigns of the said property or any part thereof or interest therein, and any party in possession or occupancy of said property or any part thereof, and shall inure to the benefit of and shall be enforceable by the Town of Casco by and through its duly authorized representatives. This Amended and Restated Contract Zoning Agreement shall be enforced pursuant to the land use enforcement provisions of state law (including 30-A M.R.S.A. § 4452) and the Zoning Ordinance. Following any determination of a zoning violation by the Court or the Code Enforcement Officer, the Town Meeting, after recommendation of the Planning Board, may amend, modify or rescind the rezoning of the site.

In the event that Chamberlain fails to develop the Settlers Village in accordance with this Agreement, or in the event of any other breach of any condition set forth in this Agreement, the Town Council shall have the authority, after hearing, to resolve the issue resulting in the breach or the failure to develop or operate. The resolution may include a termination of the Agreement by the Town Meeting and a rezoning of the Property to the prior or any successor zoning districts. In such an event, the Property shall then be used only for such other uses as are otherwise allowed by law; provided however, that no such enforcement action shall result in a disallowance of the use of any established single-family uses.

This Contract shall not affect the applicability of any provisions of state or federal law in effect from time to time not otherwise subject to the control of the Town of Casco.

If any of the restrictions, provision, conditions or portions thereof set forth herein is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such determination shall not affect the availability of the remaining portions hereof.

4.  Governing Ordinances:

Except as may be specifically altered by the provisions of this Contract Zoning Agreement, the Property shall in all respects be governed by the applicable ordinances of the Town of Casco as they may exist from time to time.

5.  Miscellaneous Provisions:

This Contract shall be governed by the laws of the State of Maine. It represents the entire agreement between the parties, and may not be altered, changed or amended without the written consent of the parties hereto or without compliance with the requirements of 30-A M.R.S.A. Section 4352.

This contract shall become effective (“the Effective Date”) upon the execution hereof by all parties.

Chamberlain shall be responsible for recording an executed copy of this Contract and its attachments in the Cumberland County Registry of Deeds and shall provide evidence of such recording to the Casco Code Enforcement Officer.

Please take note that, pursuant to 38 MRSA, Sections 413 and 414-A, Camp Wildwood of Bridgton intends to file a wastewater discharge permit application with the Department of Environmental Protection (DEP). The application is for the operation of a surface wastewater disposal system that treats sanitary wastewater, generated at a rate of up to 8,500 gallons per day, and discharges to a 1.3-acre disposal site in Bridgton, Maine.

The application will be filed on or about 3/15/2017, and will be available for public inspection at DEP’s Augusta office during normal business hours. A copy may also be seen at the municipal offices in Bridgton.

A request for a public hearing or request that the Board of Environmental Protection assume jurisdiction over this application must be received by the DEP, in writing, no later than 20 days after the application is found acceptable for processing, or 30 days from the date of this notice, whichever is longer. Requests shall state the nature of the issue(s) to be raised. Unless otherwise provided by law, a hearing is discretionary and may be held if the Commissioner or the Board finds significant public interest or there is conflicting technical information.

Sealed proposals are being accepted for the Town of Bridgton Salmon Point Bath House and Utility Room Install Project (the “Project”), which consists of obtaining competitive bids from responsible and responsive Contractors for a complete and properly functioning 19’ 3” x 22’ bath house and utility room consisting of male and female restrooms, as outlined or implied in this Request for Bids.

A mandatory pre-bid meeting will be held on Wednesday, February 22, 2017, at 9:00 a.m., at the Bridgton Town Office, 3 Chase Street, Suite 1, Bridgton, ME 04009. Attendance at this meeting by the Contractor or the Contractor’s qualified representative is a mandatory prerequisite for the acceptance of a bid from that Contractor.

Public Notice of Intent to File

Please take notice that Bridgton Hospital, located at 10 Hospital Drive in Bridgton, Maine, phone (207) 647-6000, is intending to file an air emission license application with the Maine Department of Environmental Protection (DEP) pursuant to the provisions of 38 M.R.S.A., Section 590 on or about January 15, 2017. Bridgton Hospital is proposing to renew its 06-096 minor source air emission license. No new construction or modification of license terms and conditions are being proposed.

According to Department regulations, interested parties must be publicly notified, written comments invited and, if justified, an opportunity for public hearing given. A request for a public hearing or for the Board of Environ-mental Protection to assume jurisdiction must be received by the Department, in writing, no later than 20 days after the application is accepted by the Department as complete for processing.
